The Cedar County Commission met May 24, 2021. Present were: Marlon Collins, Presiding Commissioner; Don Boultinghouse, Northern Commissioner; Ted Anderson, Southern Commissioner; Heather York, County Clerk.

Met with John Clemons Sr. and Lachelle Clemons to discuss CAFO Ordinance

Provided documentation of cost spent to date for a free range organic chicken CAFO. Gravel work has been done, but no concrete has been laid to date.

The Clemons maintain that they were under the understanding that SB391 supersedes the county ordinance; the County Commission explained that the ordinance still stands as they are in litigation with the State of Missouri over SB391.

The commissioners were invited by Mr. Clemons to the site later in the morning to see the location, the work that has been done to date, and to evaluate the best scenario for the circumstances.  They county commission will contact our attorney before moving forward.

Met with Chad Pyle, Assessor.

Requests to process court order #26709-26721, to add-on the assessed valuation of newly purchased personal property.

10:00 a.m. Road Closure Hearing CR550

Presiding Commissioner Collins called hearing to order and read the road closure for CR550 being requested by Travis Stoll.  Two land owners, Travis Stoll and Jeremy Rheam, border this strip of road that falls between State HWY’s U and 32.  Because he could not attend the hearing in person, Mr. Rheam requested a phone call to discuss his concerns.  Mr. Stoll was not present.  Mr. Rheam noted that this was his emergency access and that if he had to enter from the highway that he would not be able to enter through the fields to get to the residence.

Motion by Anderson to remain open due to residence access, second by Boultinghouse. Yes – Collins, Yes – Boultinghouse, Yes – Anderson.   

Met with HIC Group Benefits

Not recommending a self funded program, purchase a high deductible plan, and build a reserve.  They are not a consortium.  A $1,000 assessment fee was mentioned; we will inquire further as to this criteria.  They wrote MIRMA plan.

They are in the following counties and cities: Scott 2 yr, Dallas 1st year, Grundy 2 yr counties, City of Nevada, and City of Noel.

Met with Nick Allison, Economic Developer with Kaysinger Basin

Kaysinger is still working on the Broadband Project.

Army Corp of Engineers is not progressing very quickly on the Friends of RB project and there are concerns over whether there will be any development options.  A.C.E. says its delays are due to the presidential changeover.

Installed the Missouri 200yr commemorative flag in front of the Courthouse.

Met with Kevin Morgan, Bear Creek Special Road District Commissioner

Report of resident requesting paved roads; not enough funding to do this and it isn’t required.

Met with DJ Ford, Road & Bridge Supervisor

Opened a ditch on CR501, did work on CR1500 where dirt had washed into the road, bladed CR601.

Discussed still awaiting repairs be made on Cat Grader.

Diamond Mower is out of warranty needs a repair with a retrofit part.

Older MAC truck needed a transmission repair.

Ordered a bunch more plastic pipes.

Biligmeyers are ordering pipe thru West Pipe for us to install.

Discussed air conditioning units to be installed in the pros atty office and the University ext.  The road & bridge unit doesn’t keep up with the space it’s in.  Will install that one in the university ext office and purchase new ones for the pros atty office and barn.

Call to Stephen Jeffrey to discuss CAFO, no return call was received.

Commission requested detail of inmate housing from 2019-2020.

Reviewed approved minutes report from CCMH.

Bills were approved.

Payroll was approved.

Met with citizen concerning access to CR1001 off of K HWY

Research indicates the road has been abandoned but never closed.  The road easement still exists and no fence exists on either side of the easement but there will need to be some clearing as there is only about 12’ of road bed available.

Discussed changes that took effect in the new 2021-2023 lake patrol contract; Sheriff will contact the Corp for clarification.  He and the County Clerk will review where the contract increase was to be applied, whether for wages, equipment, or for fuel costs.

Presented “Amendment to Correctional Communications Service Agreement” with City Tele-coin Company Inc. with the addition of a Metal Inmate Tablet Charging Station due to the damages to original equipment incurred by inmates.  This agreement extends the original contract by 2 years with a new termination date of February 19, 2026.

Discussed air conditioning units to be installed in the pros atty office and the University ext again.  DJ will stop by Stockton Hardware this afternoon to purchase new units for the pros atty, and University Extension Office’s.  The road & bridge unit needs a bigger model than originally anticipated.  They will retain their current model for the time being and look for a bigger one or add a small one the supervisor office.

Discussed status of FEMA project, work is very close to being completed by the department which will allow road and bridge to move onto regularly scheduled task.

Contacted a resident to report a complaint received about musk thistles; he is working on this and has been digging and spraying, and will continue to do so.

Resident called to report need for a culvert on CR550 and CR151.

Reviewed a Resolution and Waiver prepared by Attorney Stephen Jeffrey concerning the Clemons CAFO project.  The Resolution will be approved if the Waiver is approved by the resident.

Reviewed the new omnibus bill approved by the Senate that attached the Sheriff’s annual salary to the Associate Circuit Judge and increases the Sheriff’s salary by a percentage of the judge salary based on the counties assessed valuation.  County Clerk will make inquiries for clarification on variables that apply and report back to the Commission.   

Signed a Letter of Certification Utilities “Status” and Railroad Statement submitted by Great River Engineering for BRO-B020(18).

Received an updated bid from Gentile Plumbing; the original bid was for 17 touchless fixtures for $12,187, the new bid includes the addition of 14 fixtures not previously bid for $9,978, for a total project bid of $22,169.

Reviewed weekly MAC news report, monthly reports from Circuit Clerk, and Recorder of Deeds Offices.

Bills and payroll were approved.
